Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Koi Fish Labs Inc. ("we," "us," or "our") governing your use of the Eizo macOS app, the eizo.dev website, and the api.eizo.dev backend (together, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
What the Service is
Eizo is a macOS screen recorder and editor: it captures your screen, mouse, and (optionally) microphone or camera, and lets you edit and export a polished video — entirely on your Mac. It also offers an optional cloud feature, available after you sign in, that generates video from a prompt or reference images/video using a third-party AI model we operate on your behalf.
Eligibility
You must be at least 13 years old, and at least the age of legal majority in your jurisdiction to enter into these Terms on your own behalf, to use the Service. If you're using the Service on behalf of an organization, you're agreeing to these Terms for that organization and confirming you have authority to do so.
Accounts and sign-in
The AI generation feature requires signing in with your Google or GitHub account. You're responsible for maintaining the security of that account and for all activity that occurs under your Eizo session. Notify us promptly at support@koifishlabs.com if you suspect unauthorized use of your account.
Acceptable use
You agree not to use the Service to:
- Record, generate, or distribute content that is illegal, infringing, defamatory, or violates a third party's rights, including intellectual property, privacy, or publicity rights.
- Submit images, videos, or prompts to the AI generation feature that you don't have the rights or permission to use.
- Generate sexually explicit content involving minors, non-consensual intimate imagery, or content intended to deceive (for example, misrepresenting a real person's likeness without consent).
- Attempt to circumvent usage quotas, rate limits, or the account/session model, or to access another user's account or data.
- Reverse-engineer, scrape, or probe the backend to identify or access the underlying AI infrastructure provider directly.
- Interfere with or disrupt the integrity or performance of the Service, or introduce malware.
- Use automated means to access the Service outside of the app and CLI we provide.
We may suspend or terminate access for violations of this section, with or without notice, depending on severity.
Your content
You retain all rights to the recordings, projects, and exports you create locally with Eizo — we never receive them and claim no rights to them. For content you submit to the AI generation feature (prompts, images, reference videos, and the resulting output), you retain your existing rights in what you submitted, and you grant us a limited license to transmit, process, and return that content solely to provide the generation you requested. You represent that you have the necessary rights to submit that content and to use the resulting output.
AI-generated output
AI-generated video is produced by a third-party model and provided "as is." We don't guarantee that output will be accurate, original, free of third-party rights, or fit for any particular purpose. You're responsible for reviewing generated output before publishing or otherwise relying on it, including for potential resemblance to existing copyrighted or trademarked material. Don't rely on AI-generated output for factual claims.
Fees and usage limits
The Service is currently offered free of charge, subject to a monthly generation-time budget and per-minute rate limit tied to your account, both of which may change without prior notice. We reserve the right to introduce paid plans or usage-based pricing in the future; if we do, we'll give you reasonable advance notice before charging you anything. Exceeding fair-use limits may result in throttling or temporary suspension of the generation feature.
Third-party services
Parts of the Service depend on third parties — Google and GitHub for sign-in, and an AI infrastructure subprocessor for generation (see our Privacy Policy for details). Your use of those integrations is also subject to the applicable third party's own terms. We aren't responsible for outages, changes, or content-moderation decisions made by third-party providers.
Intellectual property
The Eizo name, logo, app, and website — apart from your own content — are owned by Koi Fish Labs Inc. and protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal or internal business purposes. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer the app except as permitted by law.
Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by applicable law. We don't warrant that the Service will be uninterrupted, error-free, or secure.
Limitation of liability
To the maximum extent permitted by law, Koi Fish Labs Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim arose, or (b) 100 USD.
Termination
You may stop using the Service at any time by uninstalling the app and/or signing out. We may suspend or terminate your access to the Service, in whole or in part, if you violate these Terms or if we discontinue the Service or a feature of it. Sections that by their nature should survive termination (including Your Content, Disclaimer of Warranties, Limitation of Liability, and Governing Law) will survive.
Changes to the Service or these Terms
We may modify or discontinue the Service, or any feature of it (including the AI generation feature), at any time. We may also update these Terms; we'll update the "Last updated" date above, and material changes will take effect once posted. Continuing to use the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of Japan, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Japan.
